Legal basis in the cash register market
Following the end of self-certification (French “auto-certification”), POS certification has been mandatory in France since mid-2025. This certification is based on the official tax guide for POS certification (BOFiP of April 2025) from the French Ministry of Finance. The basis for this is Article 88 of the Loi de finances rectificative pour 2016. The use of POS systems that are not certified by an official certification body will no longer be permitted from this date.
This affects all companies that fall under the French fiscalization obligation. This applies in particular to the retail and catering sectors.
Fiscal requirements for a cash register in France

- Ensuring that data cannot be changed after it has been recorded
- Security against data manipulation
- Transaction data must be archived securely, completely and traceably
- Verifiability and traceability of transactions and changes by tax authorities
